Grievance Letter Regarding Contracted Raises

Dear Dr. Furmanski:

In telephone conversations in the past month with the Office of Labor Relations and University Human Resources, the Union has inquired whether management is prepared to implement the merit portion of URA-AFT's salary package for the upcoming Fiscal Year 2009-2010 on July 1,2009, as specified in our agreement, Article 38, Salary Improvements Section C. 2. A.

As

of today, the union has received no answer to that question, nor any other communication from management. Our members have not been notified of their merit awards for 2009-2010, and hundreds have received no performance appraisal at all, in violation of Article 38, Section B. 1. A.

The Union concludes that management has neither the intention nor the ability to apportion and implement the merit portion of our package on July 1. The Union has publicly offered to delay implementation of the Salary Improvement program until September of2009, in order to avoid hasty layoffs and provide for retroactive pay.

We have received no response to that offer, but layoffs of our members have been announced in some departments. So it is clear that the failure to implement Article 38, is not a response to our offer.

For this reason, the Union is hereby grieving the violation of Article 38. It appears to the Union that this grievance should begin at the 3rd step. Please let us know when you can meet regarding this grievance.
